HEADPHONETRASH COMMISSIONS
Thank you for your interest in commissioning me!This information is for the use of myself (referred to as ‘the artist’, ‘HeadphoneTrash’, or ‘Miette/Joseph Simpson’) and any customers or commissioners (referred to as ‘the commissioner’) for the process of ordering and creating custom commissioned art pieces (referred to as ‘the commission’, ‘completed piece’, ‘artwork’, etc) from HeadphoneTrash.> My commission information thread can be found here on Twitter.

1.0. Payment Details & Fees
Payments are NOT accepted until your commission has been confirmed and you have been contacted. After approval, your commission will be added to the current queue or waitlist. Payment can be sent in full at this time OR once the initial sketch has been approved by you. Payments are accepted via PayPal or Ko-Fi only.Alterations during the sketch phase are free and encouraged, but any MAJOR changes or alterations to the piece after this are subject to a scaling post-sketch alteration fee, listed in the price details of the commission tier. Major changes are considered per my discretion and on a case-by-case basis. Examples of major changes include: redrawing over half the pose, changing angles, outfit changes, character design changes, adding or removing props, etc.
1.1. Commission Outline & Timeline
Work in Progress (WIP) screenshots will be sent at the request of the commissioner. I encourage you to ask for them as you see fit, but please be courteous and limit the request frequency. Weekly updates are suggested.When your commission is completed, you will receive a high-resolution (300dpi) PNG of your commissioned file via Discord, Email, or an otherwise specified method. Commissions posted to my social media will be lower-resolution artwork.The time for your commission to be completed can be up to 3 months, but can depend on many factors including (but not limited to): my personal health, the commission queue, complexity of the commission, school, work, or personal events. If there are any reasons for delay, you will be notified as soon as possible.You may not request to be put at the front of the current commission queue for any reason, regardless of reason, and I do not accept rush payments or bribes to do so. If there is a certain date you would like this commission to be completed by, please outline this in your inquiry and discussion with me. Particular due dates are not honored unless agreed upon in writing (either digital or physical) between both parties (myself and the commissioner).
1.2. Rights of Artist & Commissioner
Commissioners, by default, are allowed to: Use the commissioned artwork for personal use only unless discussed and agreed upon; print the art and claim the rights of their characters (not the art itself); and use the art to promote themselves with proper credit given to the artist.Commissioners are NOT allowed to: reproduce or copy the artwork to use commercially (making any sort of money in any way, regardless of currency), taking credit for the creation of the artwork, removing my watermark and/or signature, use in marketing, NFTs, use in AI, or alter the artwork in any way without my consent.Any infringement upon these rules will result in a permanent blacklist from commissioning me and a formal report against the upload or post related to your infringement.I retain all rights to the art I create and am allowed to use them for promotion, use in my portfolio, social media, etc. If you would like the piece to stay private or otherwise have restrictions on where/when/how I post it, i.e. a present for another person, a holiday piece, etc., please make that clear in your initial inquiry. No fee will be incurred for this change but the request must be made in advance. Any privacy requests made after the piece is completed or posted to my social media will not be honored. Making a piece private does NOT change rights of the artist and commissioner outlined in this document.To purchase the commercial rights to the artwork will incur a 300% fee of the original price. Commercial rights given to you include: consent to make any sort of merchandise or advertising with the artwork for use in books, covers, props, posts, etc., private/personal changes allowed, and promotion of your own brand or business allowed with use. Credit is still required for usage of the artwork, regardless of editing/alteration/use.Any characters portrayed in the commissioned work remain copyrighted to their rightful owners.
1.3. Cancellation Policy
I hold the right to cancel and refund the payment of your commission at any time. You have the right to cancel your commission if payment has not yet occurred. You cannot cancel or demand a refund from the artist under any circumstances AFTER payment is received OR the sketch phase is approved.If you file a chargeback against me, your rights to your commission (listed above) are retracted and you will be permanently blacklisted from commissioning me.I have the right to decline any commission request that I am uncomfortable with or find unreasonable.
By commissioning me, you agree to all of the above.
